The Environmental and Real Property Law section consists of 2 attorneys who are experts in environmental and real estate law, and who provide advice to base leadership, the Environmental Branch of the Civil Engineer Group, and the base populace on a broad spectrum of environmental and real property matters, including:
- National Environmental Policy Act (NEPA)
- Environmental Baseline Surveys (EBS)
- Clean water, water rights, wetlands
- Storage tanks
- Natural resources
- Cultural ressources
- General range issues – Utah Test and Training Range (UTTR)
- Qualified Recycling Program (QRP)
- Pollution prevention (including affirmative procurement)
- Environmental aspects of IG inspections
- Environmental Management System (EMS)
- Clean air
- Enhanced Use Lease – west side development
- Real estate
- Base housing issues, privatization
- Noise, Air Installation Compatible Use Zone (AICUZ), encroachment
- Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA)
- Installation Restoration Program (IRP), contamination clean-up and restoration
- Solid and hazardous waste, hazardous materials
- Toxic substances and materials; includes asbestos, lead-based paint, Toxic Release Inventory
- Occupational Safety and Health Administration/Occupational Health (OSHA/OH)
The section also advocates for the base in the rare instances of regulatory enforcement actions, but its success is measured in prevention of enforcement actions and other adverse environmental issues. To that end, the section works very closely with our clients and provides education and training on environmental and real estate issues.
